Service

Genex LogiSolutions Private Limited (“Genex“) enables users to pay electronically for goods and services through its transaction services. By using the services provided by Genex, you (“User”) agree to the following terms and conditions.

Definitions

  • User: Any individual or entity utilizing Genex’s services upon acceptance of these Terms and Conditions.
  • Personal Information: Includes details such as name, phone number, alternative contact number, and address.
  • Non-Personal Information: Includes purchase details and purchase history.

Service Provision

  1. The Genex service is accessible through various platforms including merchant/seller websites, SMS, or email.
  2. Genex does not guarantee the quality or authenticity of the goods ordered or the outcomes from using such goods. Delivery will occur upon confirmation of payment from the selected Bank, subject to factors beyond Genex’s control such as connectivity issues.
  3. All charges paid by the User for the service are non-refundable. Genex does not charge for the service, but Users are responsible for any associated costs like SMS charges or communication link charges.
  4. Use of the service may result in cookies being stored on your system until deleted by the User.

Acceptance of Terms

By accessing or using Genex’s services, you agree to be bound by the current version of these Terms and Conditions, which may be updated periodically without notice. Continued use of the service indicates acceptance of any changes. Users are advised to review these terms periodically.

Eligible Customers

To use Genex’s services, individuals must be at least 18 years old and legally capable of entering into binding contracts under applicable law. Corporations, trusts, associations, or firms must have authorized individuals to agree to these terms. Non-Resident Indians may use the service only as permitted by Indian laws and those of their country, bearing full responsibility for any legal violations and indemnifying Genex and its partners.

Data Storage

Genex and its partners will store User data, including transaction history, for eight years on systems currently located outside India.

Member Conduct

Users must comply with all applicable laws and regulations. Genex disclaims liability for goods or services purchased through its service. Any disputes must be resolved with the merchant/seller. Genex reserves the right to monitor and disclose information to comply with legal requirements.

Disclaimers

  1. Genex provides the service “as is” without warranties of any kind. This includes, but is not limited to, warranties of accuracy, continuity, availability, merchantability, fitness for a particular purpose, and non-infringement.
  2. Genex disclaims liability for any damages arising from the use of its service, including but not limited to performance failures, errors, or unauthorized access.

Limitation of Liability

Genex and its partners are not liable for any direct, indirect, punitive, incidental, special, or consequential damages resulting from the use or inability to use the service.

Indemnification

Users agree to indemnify and hold Genex, its affiliates, and partners harmless from any claims arising from their use of the service.

Modifications to Terms and Services

Genex reserves the right to modify or discontinue the service or these terms at any time without notice. Continued use of the service constitutes acceptance of such changes.

Governing Laws

These terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Delhi, India.

General Information

Language, Copyright, and Trademarks

This agreement and related documents are in English. Company and product names mentioned herein may be trademarks of their respective owners. All rights not expressly granted are reserved.

Prohibited Activities

Users may not use the service for activities that:

Violate any law, statute, ordinance, or regulation.

Relate to transactions involving:

  • narcotics, steroids, controlled substances, or other products posing consumer safety risks,
  • drug paraphernalia,
  • cigarettes,
  • items promoting, facilitating, or instructing illegal activities,
  • stolen goods (including digital and virtual goods),
  • hate, violence, racial intolerance, or financial exploitation of crime,
  • obscene materials,
  • items infringing copyright, trademark, right of publicity, privacy, or other proprietary rights,
  • certain sexually oriented materials or services,
  • ammunition, firearms, firearm parts, or accessories,
  • certain regulated weapons or knives.

Relate to transactions that:

  • display personal information of third parties in violation of applicable laws,
  • support pyramid or Ponzi schemes, get-rich-quick schemes, or certain multi-level marketing programs,
  • are associated with purchases of annuities or lottery contracts, lay-away systems, offshore banking, or financing/refinancing debts via credit card,
  • involve sales of certain items before the seller possesses them,
  • are linked to the sale of traveler’s checks or money orders,
  • involve currency exchanges or check cashing businesses,
  • involve credit repair, debt settlement services, or insurance activities,
  • offer or receive payments for bribery or corruption.

No Waiver

The failure of Genex to exercise or enforce any right or provision of these terms does not constitute a waiver of such right or provision. A waiver on any occasion does not prevent Genex from enforcing any rights in the future.

Non-Transferability

The service provided by Genex is not transferable and is intended for the sole use of the User. Genex reserves the right to transfer, assign, or sell its rights under these terms, including the transaction data, to its successors or assigns.

Severability

If any part of these terms is found to be invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed replaced by a valid, enforceable provision that closely matches the original intent, and the remaining terms will continue in effect.

Notices, Transaction Records, and Electronic Disclosures

Notices to Users may be made via email or regular mail to the address provided. Notices may also be provided through publication in newspapers or displayed on the Genex website. All notices will be effective three days after posting or upon receipt in the case of hand delivery.

Users consent to receive all disclosures and notifications electronically. If a User wishes to receive disclosures in another form, they must inform Genex immediately, which may result in the termination of the service.

Transaction records generated by the use of the service are conclusive proof of the transaction’s genuineness and accuracy. Genex is not obligated to retain transaction records beyond statutory requirements.

Governing Laws

The validity, construction, and enforceability of these terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Mumbai, India.

Other Important Terms

  • Risk and Warranty Disclaimer: Use of the service is at the User’s own risk. Genex and its affiliates disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • Prohibited Content: Users agree not to misuse the service or post illegal, defamatory, offensive, or otherwise inappropriate content.
  • Validity of Provisions: If any provision of these terms is deemed invalid, the remaining provisions will continue in effect.
  • Changes and Discontinuation: Genex reserves the right to modify or discontinue the service or any part thereof at its discretion.

These terms and conditions constitute the entire agreement between the User and Genex regarding the use of its services. By using the service, the User acknowledges and agrees to these terms and conditions.
